Right of revocation and return in distance contracts.

In the case of a distance contract the consumer has a right of revocation. In the case of contracts for the delivery of goods, the consumer may be granted a right of return instead of the right of revocation.
The revocation period does not commence before the duties to provide information are given by the supplier.

§312 d Right of revocation for this Onlineshop

According §312d BGB the consumer (here: customer online shop) has a right of revocation under §355 in case of a distance contract. In the case of cantracts for the delivery of goods, the consumer may be granted a right of return under §356 instead of the right of revocation. If a consumer is granted a statutory right of revocation under this provision, he is no longer bound by his declaration of intention to conclude the contract if he has revoked it in good time. The revocation does not have to state any grounds and must be declared to the businessperson in textual form or by return of the thing within two weeks; punctual dispatch suffices to comply with the time limit.

The right of revocation ceases to exist at the latest after the conclusion of the contract. In the case of the delivery of goods the period does not begin before the day on which they reach the consignee.

In the event that he exercises the right of revocation the consumer is bound to return the thing if it can be sent as a parcel. The cost and risk of return is borne by the businessperson in the event of revocation and return. If a right of revocation exists, the normal costs of return may be imposed by contract on the consumer where the value of his order does not exceed Euro 40, if the goods delivered correspond to the goods ordered.

We'd like to provide some information about the online shop of the town Herrenberg.

Our online shop is a version of an earlier project known as  'Marktplatz-im-Gaeu' (online market place). The Herrenberg municipality endorsed this project of the trade association to provide an online market place within the electronical platform of  the Region Stuttgart. As a member of the Region Stuttgart the Town Herrenberg promoted the pilot scheme by setting up an online shop to offer tourist information guides and souvenirs.

Although the Region Stuttgart closed the virtual market place on 31.12.2003, we wanted to continue to offer our products online. Accordingly we cooperated with the Kreissparkasse Böblingen and arranged to continue our online shop. Useful link: www.s-shopping.de
